Terms and Conditions for use of ODAON

These terms of conditions (The Terms) govern your use of the ODAON website, including Basic and Premium Funeral Listings, content, reader comments, sharing, privacy and authority. The content generated on the ODAON website is intended for public access and therefore there are terms and conditions that apply to usage. 

If you do not agree with the Terms, do not use the website. If you do use the website, your conduct indicates that you agree to be bound by the Terms

When you create a Funeral Listing you are agreeing to be bound by these rules and so if you have any queries whatsoever, please contact us at enquiries@odaon.com.

We shall have the right to immediately suspend your access to the Site if you commit a breach of these Terms and Conditions with immediate effect at any time for any reason.

ODAON and H1 Design Ltd. reserve the right to amend these Terms from time to time. Any such amendment will be applicable to all persons accessing the website once the revised Terms have been posted on the website. You should therefore check the website from time to time to review the current Terms.

We do not actively moderate, monitor or edit contributions, including reader comments, or messages, but we may intervene and take such action as we think necessary. If you have any concerns over the contents on our site, please email enquiries@odaon.com.

No part of the ODAON website can be reproduced on, transmitted to or stored on any other web site or other form of electronic retrieval system, nor may any part of the site be accessed in such manner as to make it appear part of any third parties web site without our prior written consent.

Registration and Account Security

We request that all users provide their real names, email address and information, which will be used to verify your account. We use your information at sign up to verify your account and activity. This promotes both safety and security for the ODAON services and reduces the possibility of spam and trolling and allows investigation of suspicious activity or violations of the terms. As a user, you will commit to the following:

You do not supply us with false or misleading information or pass yourself off as another user.

Your email address and password are personal and may not be used by anyone else to access the site

You do not do anything to allow anyone who is not a registered user to access any registration area of the site

You do not create additional registration accounts which may cause disruption or abuse of the site

If we believe that you have not complied with these requirements, we may cancel your access to the site immediately and without notice.

Content

You are legally responsible for material you post or submit and you understand that by doing so you intend it to be published on the website.

We do not actively moderate, monitor or edit the contributions to the website.

We are not liable for any loss or damage, howsoever arising, from contributions to the website.

We do not guarantee that the ODAON website, the server that supplies it or any other of our systems will be uninterrupted or free of errors, viruses or bugs and we shall not be liable if this site is inaccessible at any time. Access may be suspended temporarily without notice for technical reasons or for reasons over which we have no control.

You give us free of charge the non-exclusive, sub-licensable right to edit, delete, copy, create derivative works from, publish, broadcast, transmit, distribute, perform, make available to the public or otherwise use and re-use material contributed by you on the website and waive any moral rights in your contribution for these purposes.

Data protection

We will use your personal details to administer this site. From time to time, we may send direct marketing emails from us. You can indicate you do not wish to receive such material at registration.

Consent

Only Next of Kin or an appointed Funeral Director will create and add Funeral Listings. If you are not next of kin, please ensure you have the relevant authority to create a Funeral Listing.

Safety

We will endeavor to keep ODAON safe, but we cannot guarantee it. As a user, you will commit to the following

You will not post unauthorised commercial communication (such as spam)

You will not collect users content or information, or otherwise access ODAON, using automated means.

You will not upload viruses or other malicious code

You will not solicit login information or access an account belonging to someone else.

You will not bully, intimidate or harass any user.

You will not post content that is hate speech, threatening or material of a pornographic nature that contains nudity

Payment

If you make a payment for a service, you agree to our payment terms

Data Policy

ODAON allows all Listings to be shared. All user identities will be retained for the sole use of administering the website and will not be passed to a 3^rd party companies. 

Permanent Website

Subject to its suspension, cancellation, and termination rights and rights to remove Material, ODAON represents that each Premium Listing page as "permanent" will remain available through the Site for the duration of ODAON's existence, unless: (a) the Site ceases to exist in whole or in part; or (b) acts or events beyond the reasonable control of ODAON cause a deletion, loss of data, failure to store, or other interruption in or termination of the availability of the Site or a Premium Listing that you own, or any other service to which you subscribed. You may at any time ask ODAON to delete without charge a Premium Listing that you purchased.

Limitation of liability

In no event shall ODAON be liable to you for any direct, indirect, special, punitive, incidental, exemplary or consequential damages, or any loss or damages whatsoever whether in an action under contract, negligence, or any other theory, in any manner arising out of or in connection with the use, inability to use or performance of the Site. ODAON assumes no responsibility and shall not be liable for any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, browsing of, or downloading of any material from the Site. ODAON assumes no responsibility or liability in any manner arising out of or in connection with any information, content, products, or material available on or through the Site, as well as any third party website pages or additional websites linked to the Site, for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained therein. In no event shall ODAON's total liability to you for all damages, losses and causes of action, whether in contract, tort (including but not limited to, negligence) or otherwise, exceed the amount paid by you to ODAON, if any.
